Utrecht Second Annual Art Competition 2010 Official Rules
THIS IS A JURIED ART COMPETITION. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN, AND NO SUCH PURCHASE OR PAYMENT WILL IMPROVE YOUR CHANCES OF WINNING.
1. Eligibility
The Utrecht Second Annual Art Competition, (“the Competition”), is open only to legal residents of the United States, its territories and possessions, who are at least eighteen (18) years old at the time of entry. Void where prohibited or restricted by law. Employees of Interweave Press, LLC (“Sponsor”), or any of its respective affiliates, subsidiaries, advertising agencies, sponsors, or any other company or individual involved with the design, production, execution, sponsorship or distribution of the Competition and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Competition is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Interweave’s decisions, which are final and binding, in all matters related to the Competition. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor
The Sponsor of the Competition is Interweave Press, LLC, 201 East Fourth Street, Loveland, CO 80537.
3. Categories. Entries will be accepted in three categories: Drawing, Painting and Sculpture. Entries will consist of digital files of each original work of art that is being entered in the Competition and shall be submitted as described in Section 5 (“How to enter”) below.
4. Timing
The Competition begins on April 19, 2010 and ends on September 1, 2010, 11:59 PM. Sponsor is the official time keeper for this Competition.
5. How to Enter
Entries to the Competition must be submitted through the website, www.utrecht.com/contest, where complete entry instructions are posted. Entries will consist of one (1) digital file of each original work of art, no larger than 800 pixels tall or wide and not to exceed 4 MB, that is being entered in the Competition. There is a limit of 3 total entries per entrant, 1 per category. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s submissions and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be returned. Sponsor reserves the right to contact entrants and all other individuals whose email address is submitted as part of this Competition.
6. Winner Selection
On or about November 1, 2010, potential prize-winning entries will be selected from among all entries, by jurors appointed by Interweave, based on quality and originality of work in each category. Prizes will be awarded for first place, second place and third place finalists in each category. Fourth place, fifth place and sixth place finalists in each category will receive an Honorable Mention certificate. One grand prize winner will be selected by the jurors from among the first place finalists in all categories. All finalists will receive a Certificate of Merit. Jurors will be appointed by Sponsor and will include staff members of American Artist, Artist-in-Residence from Utrecht and faculty from the Grand Central Academy of Art.
Each entrant whose entry has been selected as a potential prize-winner will be contacted using the email address, phone number or mailing address provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these Official Rules). Sponsor’s decisions as to the administration and operation of the Competition and the selection of potential winners is final and binding in all matters related to the Competition. Winners will be notified on or about November 1, 2010.
POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHO’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE COMPETITION AS SET FORTH BELOW.
7. Verification of Potential Winner
Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winners will be notified by email, telephone, or registered mail after the date of judging. The potential winners will be required to sign and return to Sponsor, within ten (10) days of the date notice is sent, an affidavit of eligibility, liability/publicity release, and other applicable documents in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted or fails to sign and return the foregoing documents within the required time period (if applicable), if the prize or prize notification is returned as undeliverable, if any aspect of the Competition is prohibited or restricted under the laws of the potential winner’s place of residence, and/or if the potential winner is disqualified for any other reason, no prize will be awarded to the disqualified entrant and another potential winner will be selected as described above.
8. Prizes. All finalists receive a Utrecht/American Artist Certificate of Merit. In addition, the following prizes will be awarded.
Grand Prize (Best Overall): a 6-week full scholarship at the Grand Central Academy of Art (valued at $4,000) and up to $3,500 in travel and accommodation expenses.
First Place: A $1,500 Utrecht ArtSmart gift card to first place winner in each category.
Second Place: A $750 Utrecht ArtSmart gift card to second place winner in each category.
Third Place: A $500 Utrecht ArtSmart gift card to third place winner in each category.
Honorable Mention: Honorable Mention certificates to fourth, fifth and sixth place winners in each category.
Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received during the Competition Period.
9. Entry Conditions. By entering the Competition, entrant represents and warrants to Sponsor as follows: (a) Entrant is 18 years old or older and is in full compliance with all of the terms and conditions of these Official Rules; (b) all materials submitted to Sponsor by entrant, including but not limited to the original work(s) of art and the digital photographs thereof (“Entry Materials”) are the original works of authorship of entrant alone; (c) all elements of the Entry Materials may be reproduced and generally used by Sponsor as contemplated in these Official Rules without the knowledge, consent or approval of any third party; (d) entrant hereby grants Sponsor the irrevocable, perpetual, worldwide, assignable and royalty-free right to use the name, image, likeness, comments and biographical data of entrant, and to photograph, adapt and reproduce the Entry Materials, in its various products and services and the related advertising, publicity, promotional and marketing materials of Sponsor in any and all media, and to permit others to do so; (e) no use of the Entry Materials and/or the other information or materials provided by entrant will invade, infringe, injure and/or interfere with the rights of any third party and/or expose Sponsor to any claims or liabilities to third parties, and (f) entrant is solely responsible for payment of taxes that may be imposed by reason of the prize(s) awarded to entrant.
10. Waiver and Release
By entering the Competition, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the jurors and the Sponsor, which are binding and final in all matters relating to the Competition; (b) waive and release the Sponsor, each of their respective parents, subsidiary, and affiliated companies, the jurors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, sponsoring, advertising or promoting the Competition, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability (including reasonable attorneys fees), including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a entrant’s entry, creation of an entry or submission of an entry, participation in the Competition, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Competition and/or entrant’s acceptance, use or misuse of prize.
11. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Competition, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Competition, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability
Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Competition; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Competition; (4) technical or human error which may occur in the administration of the Competition or the processing of entries, including but not limited to errors resulting in the non-delivery, loss, destruction or corruption of an entry; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded.
13. Disputes
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, other than those concerning the administration of the Competition or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, shall be resolved exclusively by the United States District Court, District of Colorado or the appropriate Colorado State Court located in Larimer County, Colorado; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Competition, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules (whether of the State of Colorado or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Colorado.
14. Entrant’s Personal Information
Information collected from entrants is subject to the Sponsor’s Privacy Policy which is available at http://www.interweave.com/privacy_policy.asp.
15. Competition Results
For results of the Competition and/or a copy of these Official Rules send a hand-printed, self-addressed, stamped envelope to Utrecht Art Supply Second Annual Art Competition, 201 East 4th St, Loveland, CO 80537. Requests for the winner list must be received by November 1, 2010.
